Development Planning : BP vs William Rennie : Expert Witness Evidence

LOCATION: Comrie, Fife
CLIENT: Paull & Williamsons Solicitors
STATUS: Ongoing

Fairhurst were instructed by Paull & Williamsons Solicitors to provide engineering, planning and urban design advice to support BP Exploration response to a £ 7 million compensation claim. Fairhurst’s Geo-Technical Division and Planning & Development Division formed part of a specialist multi-disciplinary team which was assembled to provide expert witness evidence and detailed information in relation to ground conditions, mining stability, urban design and planning.

This work supported the client throughout an arbitration hearing, where Fairhurst Geo-Tech professionals provided expert witness relating to the ground and mining conditions, and the process for treating such matters in housing developments. Fairhurst Planning & Development professionals provided expert witness relating to the detailed design and layout of housing developments planning procedures, interpretation and adherence to legislation and detailed aspects of planning case law.

The arbitration hearing itself has now finished, and a final decision in relation to the original compensation claim is expected early 2009.
